Crossfire Hurricane began as a counterintelligence investigation on Strzok's desk. I don't know the legal standard required by the DOJ for opening a counterintelligence investigation but having a "reasonable suspicion" of unlawful activity is broadly accepted as the minimum standard for law enforcement personnel to conduct lawful further inquiry. I would presume (and also hope) that a DOJ counterintelligence investigation conducted at the highest levels of the Department of Justice would require more than just a whiff of suspicion.
The 4th Amendment governs the issuance of warrants by a court. To protect the citizen against unreasonable searchs and seizures a court must be presented with evidence establishing "probable cause" that a crime has been (or is being) committed. Probable cause evidence is evidence, even if incomplete in totality, which indicates that it is probable that a crime has been committed. Thus, and based on this proffered evidence, a court issues a warrant that permits governmental authority, within the scope of the warrant, to search for additional evidence of said crime.
Following Director Comey's duplicitous leaking of notes from a sensitive/confidential meeting with the President, swiftly followed by the appiontment of a special counsel (also avvered by Comey as his purpose for leaking to the Columbia professor), the Crossfire Hurricase case is transferred to Mueller.
Now let's skip ahead to Volume One of the Mueller report on russian collusion. After a two year investigation Special Counsel Mueller did not find, as a factual matter, collusion between Trump and the Russians. In fact, Mueller testified that his investigation did not uncover collusion between Trump, Trump's campaign, or "any person", and Russia, running up to the 2016 presidential campaign.
Which begs the obvious question: If there was sufficient credible evidence to open a counterintelligence investigation at DOJ, and a sufficient factual basis for a court to issue warrants based on probable cause, then why the fuck couldn't Mueller and his team find any actual facts which established the Russia collusion narrative?
Mueller didn't find anything because there was never anything to find.
To Durham's remarks about not accepting Horowitz's conclusion that the FBI had predication to open a case, the Mueller report itself is the most damning evidence regarding the lack of predication. A two year investigation. Facts supporting Crossfire Hurricane or the FISA warrants? Zip. Zero. Zilch. Nada.
