Federal versus State (not talking about branches of power)

For one the comments were fake news and for two he’s a Federal oversight. You cannot have the federal government step into the ring until after the states have concluded their constitutional right to send electoral is. The only federal authority who can step in right now is the State Supreme Courts / Circuit Courts and US SCOTUS.

If Barr would do something right now, he breaks the constitution. Gotta wait a little longer.

Makes sense! Original filing was under the pretense of the State’s Dominion Systems. The judge denied that based on the physical control of the system is maintained by the counties, which required to ruling to be updated.

He also expanded the definition of altering the DOMINION systems in those specific counties ensuring no way to work around his ruling. Now obviously this now falls on the Counties to abide by the law.

I think you are reading what the defendants wanted.

The Judge said:

Any injunction the Court issues would extend only to Defendants and those within their control, and Plaintiffs have not demonstrated that county election officials are within Defendants’ control. Defendants cannot serve as a proxy for local election officials against whom the relief should be sought. Jacobson v. Fla. Sec’y of State, 974 F.3d 1236, 1256 – 58 (11th Cir. 2020). Therefore, to the extent Plaintiffs seek emergency relief to impound and preserve the voting machines,** that request is denied.**
