I see you’ve me never been to federal court. They give out downward departures for sentencing like candy. “Acceptance of responsibility,” aka pleading guilty, gives you a downward departure. If you’re below a certain level in the sentencing guidelines, which Clinesmith undoubtedly is because he’s a first-time offender, you get an additional downward departure. “Minor role,” which just about everyone gets, is another downward departure.

Even without any significant cooperation, Clinesmith wouldn’t get more than Papa D got, which was 14 days.

Plea deals are not routinely about people “flipping” to get a better sentence. The government will give you a better sentence simply for saving them the time and cost of a trial. Hence all the downward departures in sentencing.

That’s not to say that you won’t get an even better deal if you roll on others, but, especially in a 1001 case, the rolling isn’t required to get a good deal.

Many think Clinesmith saying he thought the information was accurate at the time means he’s not flipping. I am not sure that’s true. If he thought it was accurate, despite the email saying something different, that means he had to have another source of that information. One of the higher ups? They would be the only ones who could provide that information and have him insert it and assume it’s true.
