Did you read the article? This only applies to people who are being held already for a crime and the extension is relative to the crime committed. They still get to apply for their speedy trial and any extra time goes to time served.

It’s not unreasonable to believe the state will need a few extra days on a 48 hour hold due to the circumstances. If you’re being held for an accelerated crime your 60 day hold may be 90 and you still get time served when your sentence is handed down.

None of these criminals have lost any rights by these small temporal extensions and all I gotta say is: Don’t be a dumb fuck and end up in jail in the first place.

If I go ahead and rob a convenience store and a hundred years viral pandemic hits, I might have to expect an extra week of waiting for my sentence.

It’s not like these people were leaving the jail anytime before their sentencing or after. The extra time is applied to time served. This is a nothing burger.

Now, the release of criminals, especially those child rapists makes me want to burn it all down and bask in the glow.

You simply have it wrong. They don’t serve more time. None. None at all.

All the time served before sentencing is deducted from the sentence. It’s why you have heard the term, “released on time served” because some criminals waive their right to a speedy trial.

That's a fair question, and one that all functioning free societies have to address. When is bail appropriate? In what amount? Should it be denied? Should it be lowered for those who are less able to pay?

Ultimately "likelihood of guilt" along with severity of crime are imperfect but necessary benchmarks. We can agree that RoR is appropriate for a soccer mom turnstile jumper who is on video committing the crime, as well as a "child rapist" who was never in the same state as the child.

We may also agree that Jeffrey dahmer, ted kaszinky, and Hillary should be denied even the possibility of Bail.

It's a moving target, and it's tough to get right, the best we can hope for is to limit harm.

These people still get the right to apply for a speedy trial.

If they got the wrong person, in your hypothetical, that person would be waiting for a trial up to 60 days maximum without any kind of extension. That person would get a trial, be let go and then sue for damages.

Under the pandemic timeline, stress on the system would slow that 60 days to 90 days maximum. The wrongly accused would be acquitted and then sue for damages.

The alternative is we let these criminals go because the man power is slightly strained because of a viral pandemic and not because of negligence. That’s not acceptable. Nobody is being let off leash for major crimes just because of the circumstances.

No, brother. The law is already 60 days maximum holding time before you have to decide on a speedy trial or not. This is for the worst crimes like murder. You sit in jail and wait your turn to go through the motions. Then when sentenced, the days you sat in jail before trial are deducted from your sentence as “time served”.

A simple misdemeanor is only 48 hrs holding time. Like every movie you’ve ever seen where it’s Friday night, “but the judge doesn’t come in ‘til Monday”. Those people may wait an extra couple days. Maximum. May not be a delay at all.

Your hypothetical of being wrongly accused doesn’t have anything to do with the tiny extension in holding time. If for some off the wall reason it looks like you murdered someone, but didn’t, you’re going through the motions of the legal system anyway as a defendant. That’s a way bigger nut to crack than a couple weeks and in the end that person would sue for damages.

Here's the thing, you are not wrong that an extension of time allowed for a "speedy" trial is a horrible plan. It's just less horrible than all the others. I'm 100% in favor of whatever plan you have, as long as it doesn't "release them all" or rely on an impossible to enforce metric.

The author has absolutely made a mistake on the “additional” part. If you look at the actual verbiage he is referring, the additional time is a maximum of 30 days on the worst crimes which already carry a hold time of 60 days. See number 4.

Also, they have made other arrangements to lower the number of people who would be jailed by lowering bail to zero. This way they can prioritize on those who are already in custody to minimize the extended hold times, if there are any at all.

You’re jay walking suggestion is so far off the mark for so many reasons I’m at a loss as to how we can even respond without giving you an entire run down of the judicial system.

So by eliminating bail, combined with this, the state has now ruled that your inability to post bond means you get to spend time in jail instead?

Something tells me that the people opposing bond never saw this as a possibility. lol...

If you post bond, you will have no time served when you return to receive your sentence. If you stay in jail before sentencing, that amount of time is removed from your sentence.

Edit: The bail issue has made it so only the worst of the worst are being held for sentencing. Only they would be affected by a small delay if any at all.

Yes! This isn't that big of a deal, it just means arraignments and trials are pushed out because of the Chyna virus. You can still post bail unless you are considered high risk.

Last I checked, defense attorneys went ape shit when they called them in for court recently.

The sticky part is, it has to be either no one doing it, or enough people doing it to make it a movement. There's an old saying, that I'm not entirely sure I agree with completely, but it sums it up. Something like "Think it's time for a revolution? Great. Grab your rifle and go outside. Are you the only one out there with a rifle? If yes, it's not time yet."

If only a handful of people defy the lockdown orders or resist being falsely imprisoned, they'll just be written off as cooks and criminals, and used by the media in the most disingenuous way possible to poison the minds of normies into thinking the entire idea of saying no to overreaching government is crazy talk. I work for a lawyer here in California (civil, not criminal), and let me tell you, the court system here is jolly well fucked. There is not a single white guy left on the California Supreme Court, and no doubt this state considers that "diverse."

We used to be the model for state judiciaries and now we're a total joke. An absolute travesty. Our state bar exam used to consist of three days of exams and was considered the hardest in the nation along with New York, but in the past few years it was reduced to only two days. Snowflake millennials are being licensed left and right and they are so emotional that you cannot deal with them logically. You have to batter them into submission. Every month the state bar magazine has perhaps dozens of disbarments and even more disciplinary actions being reported. Most of these attorneys have middle eastern names.

Our judges are pushing leftist, social-justice ideology all the time. Recently, one of the Superior Court judges out here lectured a client (defendant, a man who is foreign born) on how he needed to settle with his psychotic sister who was suing him without cause because he comes from a male-dominated culture (female judge, by the way). The client was pissed, but did not back down and won with a different, white male judge who I don't know the political leanings of.

So yeah, California is fucked.

Oh sorry, not in the article. My wife works for the courts and it's all anyone has been talking about. The state was trying to find a way to keep the more serious criminals locked up and this is what they came up with. In California pedophiles are catagorized as non violent offenders. Since they are non violent the state is obligated to keep them safe while in custody. Since the virus would tear through a prison like fire they were going to have to be released.

In all fairness, my CA county went from 50 or more arrests a day to 3 or 4. Those 3 or 4 have been arrested for murder, armed robbery, etc. This just gives them longer at the jail before they go to prison. Bad Hombres. The local police pretty much aren’t arresting people or doing traffic stops.

Home of Silicon Valley should invent a way of communicating that doesn't require physical proximity. Like, a movie-type thingy which doesn't require celluloid film and that could be used in real-time with little to no delay in transmission.

They could then hold court proceedings without infringing on peoples' Constitutional Rights.

I just wonder how long the people (patriots) will put up with this until they have finally decided, ENOUGH! Most people will go along with it for a while, but there will be a point where it's gone too far. The shutdown of the country cannot go past April or they'll face a real uprising I think.
