An enemy combatant is not a US citizen. This is why gitmo exists. If we bring them here, they get constitutional protections, so they go to gitmo. If they are here already, they already have those protections and we can't send them to gitmo.
That isn't the position Justice Kavanaugh holds, and I give his opinion more weight than yours, no offense. I actually wish you were correct, as that lines up more with how I think it should be, but my opinion on the matter has as little relevence.
As I understood it, he was talking about people going to foreign countries and becoming an enemy combatant.
The day people agree that a US citizen on US soil can be sent to Gitmo (outside U.S. legal jurisdiction) is the day we should rise up and revolt.
